1. Eligibility
You must be at least 13 years old (or 16 in the European Economic Area and United Kingdom) to use the Service.
By using the Service you represent that you meet the applicable age requirement and have the legal capacity to enter into these Terms.
If you are using the Service on behalf of a business, you represent that you have authority to bind that business to these Terms.
2. Accounts
You are responsible for maintaining the security of your account credentials and for all actions under your account.
You may not share your account with others or transfer your account to another person.
Notify us immediately through the Support page at getnostalgia.ai/support if you suspect unauthorized access to your account.
3. Your Content
You retain ownership of photos and media you upload to Nostalgia ('Your Content').
By uploading content, you grant Nostalgia a limited, non-exclusive license to process, store, and display Your Content solely to provide the Service to you.
You represent and warrant that you have all rights necessary to upload Your Content and that doing so does not infringe any third-party rights.
You are solely responsible for Your Content and the consequences of uploading or sharing it.
4. Prohibited Uses
You agree not to use the Service to upload or process content that is unlawful, harmful, abusive, harassing, defamatory, or obscene.
You agree not to upload content that infringes intellectual property rights or privacy rights of others without authorization.
You agree not to use the Service to create, distribute, or facilitate non-consensual intimate imagery or deepfakes.
You agree not to attempt to reverse engineer, decompile, or extract our AI models or proprietary algorithms.
You agree not to use automated means to access the Service at scale without written permission.
Violation of these prohibitions may result in immediate account suspension.
5. Subscriptions and Billing
Nostalgia offers a free tier with limited monthly restores, and paid subscription plans (Plus and Pro) with higher limits.
Subscriptions offered on iPhone or Android are billed through Apple and Google in accordance with their respective terms and current availability.
Payment will be charged to your Apple ID or Google Play account at confirmation of purchase when a mobile subscription is available to you.
Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current billing period. You can manage or cancel an active mobile subscription in your device's Apple or Google account settings.
Prices are displayed in your local currency before purchase. Price changes will be communicated at least 30 days in advance.
For subscriptions purchased through iPhone or Android, refunds are handled by Apple or Google in accordance with their respective refund policies.
For subscriptions purchased through the web at getnostalgia.ai when web checkout is available, you may request a full refund within 14 days of your initial purchase or any renewal payment. To request a refund, contact us through the Support page at getnostalgia.ai/support. Refunds are processed by our payment provider, Paddle (paddle.com), who serves as the Merchant of Record for web transactions. After the 14-day window, refunds are provided at our discretion.
If a payment fails, you have a 7-day grace period during which your plan remains active while the store retries the charge. If the charge still fails after the grace period, your account reverts to the free tier. No photos, library data, or vault content are deleted during a downgrade.
Unused credits or quota allocations do not carry over if you cancel mid-cycle or downgrade.
6. Family Vaults
Family Vaults are invite-only shared spaces available on Plus and Pro plans. The vault owner creates the vault and invites members by email.
Vault members may have owner, editor, or viewer roles. Owners can manage members, editors can add and edit photos, and viewers can only view photos.
If the vault owner's subscription lapses beyond the grace period, vault access is suspended for all members until the subscription is restored.
The vault owner may delete the vault at any time, which removes access for all members. Photos contributed by members remain subject to the owner's deletion decision.
7. Intellectual Property
The Nostalgia brand, app design, and proprietary technology are owned by us and protected by intellectual property law.
Restoration outputs generated from your uploaded photos are provided to you for personal use. We do not claim ownership of your original photos or the restoration outputs derived from them.
You may not reproduce, distribute, or create derivative works from Nostalgia's technology, UI, or branding without written permission.
8. Disclaimers
The Service is provided 'as is' and 'as available' without warranties of any kind, express or implied.
We do not warrant that the Service will be uninterrupted, error-free, or that restoration results will meet your specific expectations.
AI-generated restoration outputs should be reviewed before use in archival, publication, or professional contexts.
9. Limitation of Liability
To the maximum extent permitted by law, Nostalgia's liability for any claim arising from these Terms or the Service is limited to the amount you paid to us in the 12 months preceding the claim.
We are not liable for indirect, incidental, special, consequential, or punitive damages, including loss of data, even if advised of the possibility.
Some jurisdictions do not allow limitation of liability for certain damages; in such jurisdictions our liability is limited to the maximum extent permitted by law.
10. Termination
You may delete your account at any time from account settings. If you only joined the waitlist and never created an account, you can unsubscribe from updates using the link in any email or by contacting support.
We may suspend or terminate your account if you violate these Terms or if we discontinue the Service.
Upon termination, your right to use the Service ceases. Data deletion follows the timeline described in our Privacy Policy.
11. Governing Law and Disputes
Nostalgia is updating its formal company structure. Until a final operating entity and contracting jurisdiction are published, these Terms are administered by the service operator identified in the applicable product, purchase, or account flow in effect when you use the Service.
If a dispute arises, contact us first through the Support page at getnostalgia.ai/support so we can try to resolve it informally. If the dispute cannot be resolved, any mandatory consumer-protection, venue, arbitration, or local-law rights that apply where you live continue to apply.
We may publish updated governing-law and dispute-resolution terms once company formation and counsel review are complete. Any such update will apply prospectively after notice as described in these Terms.
Nothing in these Terms limits rights you have under mandatory consumer-protection laws in your country of residence.
12. Changes to These Terms
We may update these Terms from time to time. We will notify you of material changes by posting a notice in the app or by email at least 30 days before changes take effect.
Your continued use of the Service after the effective date constitutes acceptance of the updated Terms.
